    Let me add one more option to the above 2. Talk to your employers thru whom you got the approved I-140 and ask them to allow you file the I-485 since GC is for future employment u don't have to be working for them for filing I-485 now once 6 months are over with the 485 filed you can port it to ur current employer.     Thanks NikNikon for the advice. I shoot everything from inside the arena so I can move between events to get the best position. Right know the strobes are out of my budget. Thanks MatsP also for your input. After your comments and talking with someone from Showcase here in Atlanta I feel much better :) about what I ended up with. This must be one of the toughest shooting environments you can come across. Do you think a bracket mounted flash would help any with the red eye? Also after 2200+ photos I am trying to learn to batch process pictures with photoshop. I am really please with how the unsharp mask helps the noise from the higher ISO. Any suggestions on batch processing tips to enhance sharpness, reduce noice and adjust levels & color are welcome. I have used photoshop for years in my printing trade but never learned it's full potential for use with photography. Also are any of you using Nikon's Picture Project? Particularly the D-lighting adjustment?

    Chumki, although it is not required by law, there is a risk of not filing a memo. That is why I am saying it's your decision. Are you taking the risk or not?

    You don't "have to", right! But are you willing to take the risk?

    In your case, there is no problem even if you join the new company BEFORE 180 days as long as your I-140 is not revoked or should there be an RFE for I-140, the original petitioner will respond to it even though you resigned already.

    USCIS does not care if you join the new company before or after 180 days. AC21 rule said that the I-485 is pending for more than 180 days. As long as your I-485 is pending for more than 180 days, it doesn't matter if you worked or not for the original petitioner, you can invoke AC21. USCIS will also not look if you're working for the new employer. ALL USCIS need is an employment offer which is similar to the original LC. "Offer" means you have work AFTER getting the GC.

    Eb2 - India. We filed I140 and then I-485 in July 2007. PD May 2007. Got I-140 approved. EAD / AP approved for me / spouse and Kids. They soft LUD on I-485 after one week of I-140 approval. and My spouse got the RFE.

    We just submitted a affidavit during my i485 filing in July as dont have her birth certificate at that time. Now we got RFE for my spouse saying that they need the birth certificate or Non-availability certificate. When we checked with the Birth Registration office, They have the birth certificate but with different Birth date(Her parents changed her Date of Birth during pre-school admission) - Now new DOB is reflected in all her Officical Documents(school vertificate, Passports, Driving License etc) whereas her birth certificate has the original date. Shall I submit the original Birth Certificate alongwith the Affidavit saying the mistake made by her Parents as the response this RFE. Since the Birth certificate is available in the registration office at different date, they refused to provide the non-availability certificate.

    Gurus - Please advise.

    Looks like they have begun processing applications filed in July 07.

    That is one option but given that I am not on H1 and nor with the same employer - it may not be the way to go. This is something I am going to look into and have an attorney weigh in on. Thanks!

    If she has the H4 stamped, with the validity 06/09 then she can enter using the H4.

    Yes, you can Travel as long as the H1 Visa Stamping in Un-Expired,

    My scneario was i worked for employer A,
    Had H1 visa stamping Upto Oct 2006.
    Changed employer and H1B transfer with Extension.
    Traveled to India returned, While returning Showed the New 797 to the Officer and Got the I-94 for the new date. No problem.
    Please carry just in case your new employer employement verification letter and latest paystub. Most of the time it is not necessary but just in case.

    Hi Jerrome, my situation is similar to yours, changed employer, but I have no new I-94 on my new I-797. I don't understand why no freash I-94 for me. In this case, do you see any problem to re-enter the US with previous H1-b visa stamp (un-expired) and new I-797?

    Thanks for your response. I actually work for a community mental health agency that does not have an attorney. The attorney I am working with is someone I found on my own with no ties to my company until I asked that she represent me in my green card process.

    I just got my I-140 approval and my priority date is 02/2008. I fall in the "All Charge-ability Areas Except Those Listed" EB3 and the March bulletin PD is 01MAY05. My lawyer is telling me I cant apply yet and since I am 2 semesters away from completing my Master's I should finish the course and just apply in the EB2 class. I dont have the funds to apply for this whole damn thing all over again. Can someone please help!? I've honestly turned suicidal dealing with this BS..

    Hi,

    My labor was approved recently but i am not sure wheather it is approved under eb2 or eb3.Attorney is trying to keep me in dark and saying every time you have to contact to your employer only we will not provide the details.My employer is saying your is eb2 in oral only,but when i am trying to ask him in email he is calling to me and saying your's category is eb2 only.Can you guys help me out how to find it out my category is eb2 or eb3,and he send me a pdf document,it is saying

    the department of labor has made a determination on your application for permanent employment certification(ETA form 9089) pursuant 20 CFR �656.24 and as required by the immigration and nationality act,as amended.

    Form ETA 9089 has been certified and is enslosed.This certification must be attached to the I-140 petition and filed with the appropriate office of the united states citizenship and immigration services(USCIS).

    Can some one please help me to find my case is wheather it is EB2 or EB3?

    I believe when I was young I entered with family visit visa, then I re-entered the country using a re entry visa. I assume both has expired for awhile now, although my I 94 doesn't state an expiration date, it stats "ans or status" Could you explain what that means?

    You will have to file the WH-4 form to DOL. Please do the search in this forum/internet as this has been discussed many many times.

    USCIS is cracking down on employers. Whether you are on project or not. Doesn't matter. Employer has to pay you or lay you off and provide ticket back home.
    Once you file WH-4, ball is in the court of USCIS/DOL/Employer for unpaid wages.

    My H1B extension was filed just one day before my I-485 was sent to NSC last July. I was able to get 3 years extension ...my company paid for premium processing though... I think you should be ok with filing the extension. Talk to your lawyer...

    This is not correct. you can apply for 1 year extensions if you have applied for 485 and is pending.

    My PD is August 2009 , and i seem to loose patience.....I can imagine how those people who have been in this queue from 4-5 years must be feeling........Lets hope for the best :)

    4-5 years is nothing. I have seen people pending 9 Years in EB3 India.
